IYCW intervention at the ILO Conference on 1st of June 2006

Permanent NOT Precarious work!

Honourable chair person, respected members of the 95th International Labour Conference,

Today companies around the world hire workers in different work arrangements to increase their profits. In many work places workers are hired in part-time, occasional, sub-contract work and Interim basis. This disparity in the employment contracts creates discrimination with out access to the same social benefits as permanent employees.

In some countries labour laws encourage individual workplace bargaining, forcing individual workers to bargain directly with their employers for payment and working conditions. This type of bargaining does not favour even the skilled workers. This situation leaves young workers vulnerable and creates a huge power imbalance in the employment relationship. Lack of transparency on such work agreements creates unfair discrimination within the workplace.

In many workplaces the workers are discouraged from associating with trade unions and many do not join a trade union for fear of losing their jobs

With no guarantee or right to permanent work many workers are forced to accept temporary employment for several years. It is not clear who is responsible for the working conditions and the rights of workers in such situations. Is it the Interim agency that gives the salary or the enterprise for which the workers are hired?

In all these cases workers have very little or no protection from the existing labour laws for a decent working condition, good salary and benefits. Unclear work agreements and instability at work brings a negative impact on the health, stability and over all development of the workers and on the sustainability, productivity and efficiency of the work itself.

We demand the following to

the Governments to:

o Implement the International Labour convention on hours of work in all work places and create more permanent employment.

o Apply the ILO convention on Freedom of association and the right to collective bargaining in all work places including the Free Trade Zones irrespective of the status of employment.

o Eliminate the interim job agencies and ensure the governments take the responsibility to create decent working conditions in all work places.

o Provide financial and technical support to develop the skills of the workers in temporary, interim and contract jobs so that they get more access to permanent employment.

o Enact laws and policies that promote permanent, decent and sustainable employment.

the Employers:

o Recognise and respect the rights of workers in all work places irrespective of their status as temporary or permanent with decent working conditions and equal salary. In specific respect the Freedom of association and the right to collective bargaining.

o Provide training for the workers in the temporary and interim jobs to develop their capacity to enter into permanent employment.

o Guarantee occupational health and safety in the work places to have productive, healthy and decent working environment.

the Trade Unions:

o Organise the workers in temporary work and in the informal economy under trade unions and lobby for their protection.

o Create workers associations and trade unions where the trade unions and workers organisations do not exist.

o Promote the awareness on the rights, labour laws and International Labour Conventions among the workers in temporary work and in the informal economy.

the ILO:

o Through specific conventions and recommendations ensure that the workers rights are protected from the obscure employment relations created by the interim job agencies, so as to determine who is responsible for the rights of workers.

o Secure the respect and the application of the labour laws consistent with the International Labour conventions.

IYCW calls on the Governments, employers, workers and the ILO to promote Permanent NOT Precarious work. We urge all parties to implement and respect the Fundamental Principles and Rights at work irrespective of the status and nature of their employment. It is important the International Labour Conference creates a definition of "fair employment relationship" and clarifies the obligation of the parties involved with specific convention and recommendations safeguarding the rights of the workers to have decent, productive and sustainable work.
